Information on parliamentary scrutiny

 On 29th November 2011 the Committee on EU policies started the scrutiny. The rapporteur raised subsidiarity issues with reference to the macroeconomic conditionalities.


On 15th december the Committe on EU adopted a reasoned opinion. 

The Committee considered that the legal basis of the proposal (art. 177 of TFEU) does not allow the establishement of macroeconomic conditionalities connected to the respect of the new stricter EU fiscal rules as provided in article 21 of the proposal.

To this regard stressed that such conditionalities - that could lead up to suspension of payments planned for the structural funds programmes - pursue objectives of economic policy and financial stability laid down under Title VIII of the TFEU while they do not contribute to the efficiency and effectiveness of the cohesion policies.

 In addition the reasoned opinion stresses that under art. 175 of TFEU, "Member States shall conduct their economic policies and shall coordinate them in such a way as, in addition, to attain the objectives set out in art. 174", namely the strengthening of its economic, social and territorial cohesion and reducing disparities between the levels of development of the various regions. 

In the Committee's view art. 175 implies that EU economic policies must contibute to the aims of the cohesion policy and not viceversa.

 Therefore the reasoned opinion states that art. 21 of the proposal is not consistent with art. 177 TFEU.
