The Committee on Justice discussed the proposal at its 33rd extraordinary meeting of 27 January 2014.


And at it's 91st meeting of 31 January 2014 the Committee on EU Affairs of the National Assembly of the Republic of Slovenia adopted the following Position:


The Republic of Slovenia welcomes the Proposal for a Directive and will strive for an early adoption thereof. Minimum standards for procedural rights in criminal proceedings will enable an efficient implementation of Directive 2013/48/EC governing the right to access to a lawyer in criminal proceedings.


It is in the early phase of the proceedings, especially if deprived of liberty, that suspected or accused persons are the most vulnerable and most in need of legal aid. Therefore, the Proposal lays down provisions for so-called "provisional legal aid" which brings significant added value and improved mutual trust between criminal justice systems. The Proposal provides for uniformity in ensuring the right to access legal aid in criminal proceedings at EU level and thus a higher level of mutual trust and judicial cooperation in criminal proceedings, as well as the reduction of barriers to the exercise of the right to a fair trial.     


The Republic of Slovenia stresses that the impact assessment does not clearly indicate the increase in costs resulting from the implementation of Proposal's provisions at the level of individual Member States.
