Information on parliamentary scrutiny

The Committee on Labour, Family, Social Policy and Disability discussed the Proposal on 25 May 2016 and

The Committee on EU Affairs of the National Assembly of the Republic of Slovenia adopted at the meeting held on 3 June 2016 the following Position

The Republic of Slovenia supports the efforts aimed at protecting the rights of posted workers and, accordingly, supports the European Commission's initiative for the revision of Directive 96/71/EC concerning the posting of workers in the framework of provision of services that would go in the direction of preventing the social dumping.  

The Republic of Slovenia believes that international road transport should be excluded from the scope of this directive. In relation thereto and with regard to recital 10 of the directive, the Republic of Slovenia expects the road transport sector to no longer be addressed in this directive (due to the specific nature of work in international road transport) and expects a holistic approach to this segment in the framework of regulations pertaining to international road transport  (EC Regulations 1071/2009, 1072/2009 and 1073/2009).

Given the complexity and interconnection of regulations, governing the posting of workers from various perspectives, the Republic of Slovenia believes it would be reasonable to hold the debates on the revision of the directive and the revision of social security coordination concurrently. Likewise, the Republic of Slovenia considers that it would be reasonable to proceed with the revision of Directive 96/71/EC by taking into account the evaluation of impacts of Directive 2014/67/EU on the enforcement of Directive 96/71/EC which the Member States are only transposing into their national legislations.


SECOND DISCUSSION 2017

The Committee on Labour, Family, Social Policy and Disability discussed the proposal again at its 60th extraordinary meeting of 13 October 2017.

The Committee on EU Affairs of the National Assembly of the Republic of Slovenia discussed the proposal again at it’s 144th meeting of 20 October 2017 and adopted the following Position:

The Republic of Slovenia supports the efforts aiming at the protection of the rights of posted workers and in line therewith supports the Commission’s initiative to revise Directive 96/71/EC concerning the posting of workers in the framework of the provision of services, intended to prevent social dumping.

Considering the specific nature of work in the international road transport, the Republic of Slovenia will continue to strive for a clear regulation of the posting of road transport workers.
