Information on parliamentary scrutiny

On 24 January 2017 the committees for Economic Affairs, Interior Affairs and Kingdom Relations did a subsidiarity check on the proposal and referred the subsidiarity concern to the plenary meeting on the same day. During the plenary meeting the reasoned opinion was adopted without a vote.

The reasoned opinion states among others that CO2 reduction is a joint competence of the EU and the member states. The manner in which member states can meet the objectives for CO2 reduction should therefore be left to the discretion of member states. The proposal should not put policy at risk that has already been developed in the Dutch government's National Energy Agreement.

On 20 April 2017 the European Commissioners Timmermans and Canete replied to the reasoned opinion of the Dutch Senate (reply in Dutch uploaded). The Commissioners gave an explanation to the concerns of the committees considering the proposal.

On 9 May 2017 the committees took note of the reply of the European Commission together with a letter from the minister of Internal Affairs stating the progress of the proposal in the Council.

The Economic Affairs committee and the Interior Affairs and Kingdom Relations committee took note of a letter to the Parliament from the Minister for Internal Affairs on 20 June 2017.

On 16 January 2018 the Economic Affairs and Interior Affairs committee discussed a letter from the government concerning the progress on the implementation of the proposal.

On 19 January 2018 the Economic Affairs and Interior Affairs committee send a joint letter to the government with a request to inform the committees about the outcome of the trilogue between the European Council and the European Parliament concerning the proposal.

On 13 February 2018 the Economic Affairs and Interior Affairs committee received a reply from the government  with regards to the outcome of the trilogue between the European Council and the European Parliament concerning the proposal.

On 20 February 2018 the Economic Affairs and Interior Affairs committee took note of the reply from the government and decided to close the dossier.

On 25 January 2017, the Senate of the Kingdom of the Netherlands sent a reasoned opinion to the European Commission concerning COM(2016)765. On 20 April 2017, the European Commission sent a letter responding to the objections of the Senate of the Kingdom of the Netherlands.
