The Committee for European Affairs decided on 3/9/2017 by its Resolution No. 355 to deliberate on the documents and appointed the Member Mrs. Ivana Dobešová as rapporteur.

1. takes note of the Proposal for a Regulation of the European Parliament and of the Council adapting a number of legal acts providing for the use of the regulatory procedure with scrutiny to Articles 290 and 291 of the Treaty on the Functioning of the European Union, COM(2016) 799 final, Council reference 5623/17;

2. takes note of the Proposal for a Regulation of the European Parliament and of the Council adapting a number of legal acts in the area of Justice providing for the use of the regulatory procedure with scrutiny to Article 290 of the Treaty on the Functioning of the European Union, COM (2016) 798 final, Council reference 5705/17;

3. supports the position of the Government on the Proposal for a Regulation of the European Parliament and of the Council adapting a number of legal acts providing for the use of the regulatory procedure with scrutiny to Articles 290 and 291 of the Treaty on the Functioning of the European Union, COM(2016) 799 final, Council reference 5623/17;

4. supports the position of the Government on the Proposal for a Regulation of the European Parliament and of the Council adapting a number of legal acts in the area of Justice providing for the use of the regulatory procedure with scrutiny to Article 290 of the Treaty on the Functioning of the European Union, COM (2016) 798 final, Council reference 5705/17;

5. appreciates the progress made by the Commission towards greater transparency in the delegated acts procedure compared to the provisions contained in the three legislative proposals (Omnibus I, II and III) submitted by the Commission in 2013;

6. welcomes the fact, that the Common Understanding between the European Parliament, the Council and the Commission on Delegated Acts accompanying the Inter-Institutional Agreement on Better Law-Making, addresses also the matter of regular consultation of Member States’ experts;

7. expresses doubt as to whether the procedure of consultation of Member States’ experts taking place during the preparation and drafting of delegated acts as stipulated in the Common Understanding between the European Parliament, the Council and the Commission on Delegated Acts accompanying the Inter-Institutional Agreement on Better Law-Making is definite and binding enough;

8. empowers the Chairman of the Committee on EU affairs to submit this resolution to the Chairman of the Commission in the context of political dialogue.
