Information on parliamentary scrutiny

​Joint Committee discussed the proposal at its 3rd extraordinary meeting of 18 July 2018.

The Committee on EU Affairs of the National Assembly of the Republic of Slovenia discussed the proposal again at it’s 2nd extraordinary meeting of 20 July 2018 and adopted the following Position:

The Republic of Slovenia supports the Proposal for a Regulation of the European Parliament and of the Council laying down rules facilitating the use of financial and other information for the prevention, detection, investigation or prosecution of certain criminal offences and repealing Council Decision 2000/642/JHA. Greater effectiveness in the fight against crime will be achieved by further harmonising the legislation and practice in this area, namely laying down rules for the immediate access of law enforcement authorities and Asset Recovery Offices to information contained in national centralised bank account registries and laying down rules for strengthening the Financial Intelligence Unit’s ability (FIU) to share information with their designated competent authorities in relation for all serious criminal offences. Irrespective of the above, the Republic of Slovenia does not support certain solutions relating to the exchange of information between the competent authorities and the FIUs and between EUROPOL and the FIUs for which it considers to be formulated too broadly, affecting the operational independence of the FIUs. The Republic of Slovenia believes that the text needs some improvements, as there are still a lot of ambiguities, while the text should also be aligned with the Fourth Directive (AMLD4) and the recently adopted Fifth Directive (AMLD5) on the prevention of money laundering and terrorist financing.
